Trade Marks

A trade mark is a sign which serves the purpose of distinguishing the goods produced or traded by an undertaking from the goods of other undertakings.

Service Marks

A service mark is a sign which serves the purpose of distinguishing the services of one undertaking from the services of other undertakings.

Collective Marks

A collective mark is a mark used by a group of enterprises, producers, merchants or providers of services, which serves to distinguish the goods and services of the enterprises of that group from those of other enterprises. Registration of a collective mark must be applied for collectively by the entire group (but renewal may be applied for by one of the parties concerned). When applying for the registration of a collective mark the rules governing its use must be filed. Such rules must mention the enterprises authorized to use the collective mark. Amendment of the rules is possible only with the approval of the Patent Institute. Assignment or licensing of a collective mark can only be valid after being recorded in the Register. If the owner of a collective mark disregards a use of that mark in violation of the rules, and fails to remedy the offence within the period set by the Court in response to an action brought by one of the parties, the registration of the mark will be nullified by the Court.

Guarantee Marks

A guarantee mark is a mark which, under control of its owner, serves to guarantee the common characteristics of enterprises and of the production methods, geographical signs and quality of those enterprises. On application for the registration of a guarantee mark the rules governing the use of the mark must be filed. These rules must contain provisions with regard to the common characteristics of the goods or services to which the guarantee relates, as well as with regard to the procedures for the supervision of the use of the mark and the sanctions on violations of the rules. Amendment of the rules is possible only with the approval of the Patent Institute. Assignment or licensing of a guarantee mark will be valid only after recordal thereof in the Register. If the owner of a guarantee mark disregards a use of that mark in violation of the rules, and fails to remedy the offence within the period set by the Court in response to an action brought by one of the parties, the registration of the mark will be nullified by the Court.
